Dear esteemed MFC members,
For your information, the United States Department of Commerce (USDOC) on July 17, 2024 has recently announced that it is implementing a certification requirement (Exporter Certificate) for kitchen cabinet and vanities exporters from Malaysia exporting their products to the US.
Among the HS Codes involved but not limited to are such as:
HS 9403.40.9060
HS 9403.60.8081
HS 9403.90.7080
This requirement is intended to combat the circumvention of the previous anti- dumping duties being imposed on Chinese WCV back in 2020. Manufacturers falling under Scenario 1 – 3 in the attachment provided will be facing a suspension of the liquidation of their products and imposed a cash deposit rate up to 251.64%.
While manufacturers who fall under Scenario 4 (view attachment) are exempted from the cash deposit requirement and liquidation of their products, certain documentation such as the Exporter Certification and supporting documents such as invoice, purchase order, production records are required to prove the validity of your claim.
A sample of the Exporter Certification (go to Appendix III) has been included in the attachment and you are also required to provide supporting documents such as invoice, purchase order, production records etc for the following period below:
a) Your products shipped to the US within 45 days from July 17, 2024, but no later than August 31, 2024.
b) For all wooden cabinets which entered or withdrawn from the warehouse from November 4, 2021 – July 17, 2024.
These documents are to be provided to your buyer (importer) or agent in the United States in order for them to submit it to the US Custom and Border Patrol (US CBP) by uploading it into the document imaging system (DIS) in ACE.
Note: MFC urges members which are under the scenario mentioned above to render your cooperation by preparing and submitting the documents to avoid your shipment being held up and being imposed a 251.64% cash deposit requirement by the US authorities.

美国商务部对厨柜和梳妆台出口商/制造商认证要求的通知
诚致全体 MFC 会员：
谨此通知，美国商务部 (USDOC) 于 2024 年 7 月 17 日宣布，正在对出口到美国的马来西亚厨柜和盥洗台出口商实施产品认证要求（出口商证书）。
涉及但不限于的 HS code 包括：
HS 9403.40.9060
HS 9403.60.8081
HS 9403.90.7080
该要求旨在打击 2020 年对中国厨柜和盥洗台征收的反倾销税的规避行为。依据附件中情况 1-3 的制造商，将面临暂停清算其产品并处以高达 251.64% 的现金押金利率。
虽然附件中 情况 4 的制造商可获得豁免现金押金要求和产品清算，但需要提供所需文件，如出口商认证和支持文件，如发票、采购订单、生产记录等 来证明。
随函附上出口商认证样本（附录 III），及在特定日期内需要出口商提供的证明文件，如发票、采购订单、生产记录等 ：
a) 在 2024 年 7 月 17 日起（不迟于 2024 年 8 月 31日），45天内运往美国的产品。
b) 2021 年 11 月 4 日至 2024 年 7 月 17 日期间进出库的所有木柜。
这些文件必须提供给您在美国的买家（进口商）或代理商，以便他们将其上传到美国海关和边境巡逻局 (US CBP) 的文档成像系统 (DIS)内。
注：马来西亚家具总会恳请属于上述情况的会员配合，准备提交相关文件予买家/进口商/代理商，以避免您的产品被美国当局扣留并征收 251.64% 的押金。
